New Hampshire Firework Laws and Regulations

It’s important to understand the laws and regulations that govern their use in the state. New Hampshire has some of the most lenient firework laws in the country, but that doesn’t mean you can set off any type of firework at any time. We’ll take a closer look at the firework laws and regulations in New Hampshire, including what types of fireworks are legal, when you can use them, and the potential consequences of breaking the rules. So, make sure you’re following the law and keeping yourself and others safe while celebrating.

Overview of New Hampshire Firework Laws

New Hampshire has some of the most lenient fireworks laws in the country. The state allows the sale and use of consumer fireworks, which are typically classified as fireworks that can be sold to the general public for personal use. However, there are still restrictions on what types of fireworks are legal and when and where they can be used.

The New Hampshire fireworks laws are governed by RSA 160-C, which outlines the rules and regulations for the sale, use, and possession of fireworks in the state. According to the law, fireworks are defined as “any composition or device for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation.”

Types of Fireworks That Are Legal in New Hampshire

In New Hampshire, the following types of consumer fireworks are legal:

  • Cone fountains
  • Cylindrical fountains
  • Sparklers
  • Smoke devices
  • Snake and glow worms
  • Ground and handheld sparkling devices
  • Novelty items such as party poppers, snappers, and toy smoke devices

Restrictions on When Fireworks Can Be Used

While New Hampshire has some lenient fireworks laws, there are still restrictions on when they can be used. According to RSA 160-C, consumer fireworks can only be used between the hours of 9:00 AM and 10:00 PM, except on the following days:

  • The Saturday and Sunday before Memorial Day
  • The Saturday and Sunday before July 4th
  • July 3rd and 4th
  • The Saturday and Sunday before Labor Day

On these days, consumer fireworks can be used until 12:30 AM.

Consequences of Breaking New Hampshire Firework Laws

If you’re caught breaking the fireworks laws in New Hampshire, you could face fines or even jail time. According to RSA 160-C, anyone who violates the fireworks laws can be fined up to $1,000 for each offense. In addition, if you’re caught using fireworks illegally and you cause damage to property or harm to another person, you could be held liable for any damages or injuries that occur.

It’s also important to note that if you’re caught selling illegal fireworks in New Hampshire, you could face even more serious consequences. According to RSA 160-C, anyone who sells fireworks that are not legal in the state can be fined up to $10,000 for each offense.

Fireworks Safety Tips

While fireworks can be a fun way to celebrate Independence Day, it’s important to use them safely. Here are some firework safety tips to keep in mind:

  • Always read and follow the instructions on the fireworks label.
  • Only use fireworks outdoors and on a flat, level surface.
  • Keep a bucket of water or a hose nearby in case of a fire.
  • Never relight a “dud” firework. Wait 20 minutes and then soak it in water.
  • Keep a safe distance from the fireworks. Sparklers, for example, can burn at temperatures of up to 2,000 degrees Fahrenheit.
  • Never allow children to play with or light fireworks.
  • Never consume alcohol while using fireworks.
